the power of attorney notarization is the act carried out by the notary public institute in accordance with the application of a natural person, a legal person or other types of organizations to notarize the authenticity and legality of the intention of the principal who has authorized another person to carry out legal acts in the name of the principal.
the declaration notarization is the act carried out by the notary public institute in accordance with the application of a natural person, a legal person or other types of organizations to notarize the authenticity and legality of the intention of the declarant in civil activities.
special notes:
★ the following list of materials is for reference only as specific materials may be required based on your case and requirements of notaries public.
★ the provision of certifying materials shall be originals and corresponding number of photocopies, unless otherwise specified. the photocopies shall be complete and clear and in conformity with the original (as for id card, the front and the reverse side shall both be copied).
★ the power of attorney notarization and the declaration notarization shall be applied for by the principal or the declarant before the notary public office, and they shall provide their signatures or seals before the notary public without entrusting another person to do so on behalf of them.
the following materials are required for handling power of attorney or declaration notarization:
i. identity materials of the applicant
① chinese mainland citizens shall provide id card and household register;
② foreigners shall provide passport;
③ residents of taiwan, china shall provide mainland travel permit for taiwan residents and id card;
④ residents of hong kong and macao, china shall provide mainland travel permit for hong kong and macao residents and id card;
⑤ a legal person or other types of organizations shall provide business license, organization code certificate (within validity period of annual inspection), qualification certificate and id card for legal representative, and official seal of the organization;
ii. main body of power of attorney or declaration to be notarized. where instruments to be notarized involve special requirements or formats, relevant basis and reference formats shall be provided. where instruments to be notarized involve incomplete contents or inaccurate wording, the notary public who is handling the application shall have the right to request the parties concerned to make supplements or modifications.
iii. legal basis for entrusting authorization or declaration, for example, if the entrustment involves a house, the house proprietorship certificate and the marriage status certificate shall be provided; if the entrustment involves waiver of inheritance right, the certificate of death for the decedent, the certificate of kinship between the declarant and the decedent, and the legacy voucher (such as the house proprietorship certificate and the bank passbook) shall be provided.
iv. duplicate id card (front and reverse sides) of the attorney or the interested party involved in the declaration;
v. other certifying materials deemed necessary by the notary public office.
