measures of guangzhou municipality for the protection of revolutionary relics

  (issued on march 30, 2023 in accordance with decree no. 198 of the people’s government of guangzhou municipality and put into force on may 10, 2023)

  article 1  these measures are formulated in accordance with the law of the people’s republic of china on the protection of cultural relics, the law of the people’s republic of china on the protection of heroes and martyrs, the regulations of guangdong province on the protection of revolutionary sites, the regulations of guangzhou municipality on the protection of historical and cultural cities and other relevant laws and regulations, on the basis of the actual conditions of guangzhou and with a view to strengthening the protection, management and rational utilization of revolutionary relics and promoting the revolutionary spirit.

  article 2  the term “revolutionary relics” herein refer to revolutionary sites and movable revolutionary objects.

  revolutionary sites are subject to the scope specified in article 3 of the regulations of guangdong province on the protection of revolutionary sites.

  movable revolutionary objects refer to the objects left over from revolutionary historical events and figures since modern times (1840-1949), which have significant commemorative, educational or historical values and can be moved with their original forms remaining unchanged during movement.

  article 3  these measures shall apply to the investigation, identification, protection, management and utilization of revolutionary relics within the administrative areas of guangzhou.

  for revolutionary relics classified as cultural relics, historical buildings, martyr memorial facilities or archives, if there are provisions specified otherwise in laws and regulations on their protection and management, such provisions shall prevail.

  article 4  the municipal and district people’s governments shall strengthen their leadership over the protection of revolutionary relics within their respective administrative regions, and include the funds required for the protection of revolutionary relics in their respective financial budgets. the town people’s governments and sub-district offices shall fulfill their respective tasks to protect the revolutionary relics within their jurisdictions.

  article 5     the municipal culture, radio, television and tourism authority shall organize the implementation of these measures.

  the municipal and district culture, radio, television and tourism authorities shall be responsible for organizing, implementing, guiding and supervising the work concerning the protection of revolutionary relics within their respective administrative areas.

  revolutionary relics classified as cultural relics or martyr memorial facilities shall be protected and managed by the culture, radio, television and tourism authority and the veteran affairs authority respectively in accordance with the law.

  revolutionary relics classified as historical buildings shall be protected and managed by authorities in charge of planning and natural resources, housing and urban-rural development, urban management and comprehensive law enforcement respectively in accordance with the law.

  the investigation, identification, protection, management and utilization of movable revolutionary objects shall be conducted by veteran affairs ex officio.

  the authorities in charge of development and reform, education, public security, civil affairs, finance, human resources and social security respectively shall fulfill their respective tasks to carry out the protection and management of revolutionary relics.

  article 6  organizations and individuals are encouraged to participate in the investigation and identification, repair and restoration, collection of historical data, construction of venues, display and exhibition of revolutionary relics and other protection and utilization work by providing clues, donations, funds, adoption and technical support.

  the municipal and district people’s governments and the government sectors thereof may publicize the meritorious deeds of organizations and individuals participating in the protection and utilization of revolutionary relics through such media as newspapers, radio, television and the internet.

  article 7  the municipal people’s government and veteran affairs respectively shall promote cooperation in the protection and utilization of interrelated revolutionary relics in the guangdong-hong kong-macao greater bay area, and jointly carry out the data sorting and academic research on revolutionary relics.

  the authorities in charge of culture, radio, television and tourism, planning and natural resources, housing and urban-rural development and veteran affairs respectively shall organize relevant experts and scholars, research institutions, archival and literature institutions and colleges and universities to carry out theoretical and applied research related to revolutionary relics, collect, compile and publish documents related to revolutionary relics and discover and display the cultural connotations and historical value of revolutionary relics.

  revolutionary site protection managers and movable revolutionary object collectors may, in conjunction with research institutions, colleges and universities, build co-research platforms to jointly tackle major issues related to the protection and utilization of revolutionary relics.

  article 8  the municipal authorities in charge of culture, radio, television and tourism, planning and natural resources, housing and urban-rural development and veteran affairs respectively shall make joint efforts to establish a revolutionary heritage expert database, and carry out research and demonstration work on revolutionary historical events, figures and revolutionary culture in the investigation of revolutionary relics in guangzhou.

  article 9  the municipal culture, radio, television and tourism authority shall make overall coordination in organizing the investigation of revolutionary sites in guangzhou. the district culture, radio, television and tourism authorities shall organize the district planning and natural resources authorities and the district veteran affairs authorities to conduct comprehensive investigations of revolutionary sites within their administrative areas, and report the preliminary investigation results to the municipal culture, radio, television and tourism authority.

  the municipal culture, radio, television and tourism authority shall organize the municipal planning and natural resources authority and the municipal veteran affairs authority to jointly review the preliminary investigation results, and upon completion of expert argumentation, report the revolutionary site investigation results to the provincial culture and tourism authority.

  the authorities in charge of culture, radio, television and tourism, planning and natural resources and veteran affairs respectively may fulfill their respective tasks to conduct special investigations on revolutionary sites within their respective administrative areas and report preliminary investigation results to the relevant authorities in accordance with the law.

  article 10 in case that non-state-owned revolutionary sites are involved during the investigations of revolutionary sites, the authorities in charge of culture, radio, television and tourism, planning and natural resources and veteran affairs respectively shall seek the opinions of the relevant owners and other stakeholders; if the contact with relevant personnel is unavailable, public announcement shall be made on their portal websites, at the residences of relevant personnel and the locations of the revolutionary sites, with an announcement duration of no less than 20 days.

  if the relevant owners or other stakeholders of a non-state-owned revolutionary site do not agree to include the revolutionary site in the protection catalog, the district authorities in charge of culture, radio, television and tourism, planning and natural resources and veteran affairs respectively shall, together with the town people’s government or sub-district office where the non-state-owned revolutionary site is located, communicate with the owners or other stakeholders, conduct on-the-spot survey of the revolutionary site, take photos of the current situation, make recordings and written records, and report to the superior authority the relevant information together with the preliminary investigation results.

  article 11 the people’s government of a district shall set protection signs for revolutionary sites included into the protection catalog in the unified style determined by the provincial people’s government, which shall be implemented by the district authorities in charge of culture, radio, television and tourism, planning and natural resources and veteran affairs respectively ex officio.

  if any revolutionary site that has been included into the protection catalog is damaged and cannot be repaired due to force majeure such as natural disasters, the district authorities in charge of culture, radio, television and tourism, planning and natural resources and veteran affairs shall fulfill their respective tasks to set explanatory signs for commemoration.

  the respectively shall fulfill their respective tasks to inspect the protection signs of revolutionary sites on a regular basis. if any sign is found to be damaged or lost, repair or replacement shall be arranged promptly.

  no organization or individual may arbitrarily set, move, dismantle, alter, or damage protection signs.

  article 12 the municipal authorities in charge of culture, radio, television, and tourism, planning and natural resources and veteran affairs respectively shall fulfill their respective tasks to formulate plans for the protection and utilization of revolutionary sites with such factors as the type, preservation status and surrounding environment of revolutionary sites being taken into account, and organize their implementation.

  article 13 the investigation of movable revolutionary objects in the collection of the cultural institutions shall be carried out as follows:

  (1)   the culture, radio, television and tourism authority shall be responsible for organizing investigations of the collections of museums, libraries and other exhibition venues other than martyr memorial facilities that are related to revolutionary history and cultural content;

  (2)   the veteran affairs authority shall be responsible for organizing investigations of the collections of exhibition venues classified as martyr memorial facilities.

  the registered and announced movable revolutionary relics may be directly included into the protection catalog of movable revolutionary objects.

  the district culture, radio, television and tourism authorities and the district veteran affairs authorities shall be responsible for organizing preliminary investigations of movable revolutionary objects. after organizing expert research and argumentation, the lists of movable revolutionary objects in the collections within the administrative areas of the districts shall be drafted for public comments, and then the lists shall be submitted to the municipal culture, radio, television and tourism authority and the municipal veteran affairs authority for approval and announcement to the public in a centralized way or in batches.

  article 14 state-owned organizations collecting movable revolutionary objects shall, in accordance with relevant national regulations, be equipped with warehouses and necessary facilities and equipment suitable for the preservation of movable revolutionary objects, so as to ensure the safety of movable revolutionary objects.

  where the storage requirements cannot be met or there are other reasons that may cause serious damages to movable revolutionary objects, the collectors of the non-state-owned movable revolutionary objects may request assistance from such authorities as the culture, radio, television and tourism authority and the veteran affairs authority. relevant authorities may, through technical guidance or negotiation, entrust state-owned museums, archives, memorials, exhibition halls or other venues to preserve the non-state-owned movable revolutionary objects on behalf for the sake of the integrity and safety of the movable revolutionary objects.

  article 15 state-owned museums, archives, memorials, exhibition halls or other collection organizations are encouraged to strengthen the collection, purchase and research of movable revolutionary objects. the collection and purchase shall be done on the basis of fairness and voluntariness.

  organizations and individuals are also encouraged to donate or lend their collected movable revolutionary objects to state-owned museums, archives, memorials, exhibition halls or other collection organizations. state-owned collection organizations shall respect the free will of the donor or lender, and properly collect, preserve and display the donated or borrowed objects.

  article 16 the district authorities in charge of culture, radio, television and tourism, planning and natural resources, housing and urban-rural development, urban management and comprehensive law enforcement and veteran affairs respectively shall strengthen daily monitoring of revolutionary sites and make good use of video monitoring networks, satellite remote sensing systems and other means to detect and stop illegal activities that damage revolutionary sites in a timely way.

  article 17 an emergency response mechanism for the protection of revolutionary relics in case of emergencies shall be established in guangzhou.

  the municipal authorities in charge of culture, radio, television and tourism, planning and natural resources, housing and urban-rural development and veteran affairs respectively shall fulfill their respective tasks in the light of the possibility of serious damages to revolutionary relics caused by unexpected events to guide the revolutionary site protection organizations and the collection organizations of movable revolutionary objects to formulate contingency plans for the protection of revolutionary relics and conduct regular emergency drills. the contingency plan shall cover such aspects as prevention and emergency preparedness, monitoring and early warning, emergency response and rescue, and post-emergency recovery and reconstruction.

  where an emergency causes or may cause serious damage to revolutionary relics, the revolutionary site protection organizations and the collection organizations of movable revolutionary objects shall immediately take relevant protection measures in accordance with the requirements of the contingency plan, and report to the relevant authority or the local district people’s government. upon receipt of the report, the relevant authority or the local people’s government shall promptly organize rescuing protection work.

  article 18 the district people’s governments shall, based on the revolutionary site protection and emergency response work, regularly organize the authorities in charge of culture, radio, television and tourism, planning and natural resources, housing and urban-rural development, urban management and comprehensive law enforcement and veteran affairs respectively to conduct inspections on the protection of revolutionary sites. any problem related to illegal acts found and any safety hazard endangering revolutionary sites shall be promptly corrected and dealt with.

  article 19 revolutionary site protection organizations and collection organizations of movable revolutionary objects are encouraged to use information technologies to record, sort and archive written, physical and oral historical data related to revolutionary relics, so as to achieve open sharing of data resources.

  revolutionary site protection organizations and collection organizations of movable revolutionary objects are encouraged to make use of such modern communication means as mobile applications and online memorials to promote, publicize and display revolutionary relics on line.

  the municipal authorities in charge of culture, radio, television and tourism, planning and natural resources, housing and urban-rural development and veteran affairs respectively may, through consultation with revolutionary site protection organizations and collection organizations of movable revolutionary objects, implement digital protection of revolutionary relics by using such technical means as digital virtual restoration and reconstruction.

  article 20 the organizers of exhibitions of revolutionary sites and movable revolutionary objects may carry out experiential, panoramic or three-dimensional exhibitions to promote the integration and innovation of exhibition and display forms.

  revolutionary museums, memorials, exhibition halls, revolutionary martyrs’ cemeteries, archives and other similar organizations are encouraged to increase the frequency of guide services provided by interpreters during national statutory holidays, commemorative days of major revolutionary events and red culture promotion months to meet the visiting needs of the public.

  article 21 july is the guangzhou red culture promotion month of each year. the municipal and district authorities in charge of culture, radio, television and tourism, planning and natural resources and veteran affairs respectively shall carry out such promotion activities as special reports on revolutionary culture, theme forums and special film exhibitions through newspapers, radio, television and the internet during the promotion month, and mobilize all sectors of society to organize and carry out revolutionary culture promotion and education activities, promote the revolutionary spirit, and spread revolutionary stories.

  during the promotion month, state-owned revolutionary museums, memorials, exhibition halls, revolutionary martyrs’ cemeteries, archives and other similar organizations shall carry out such mass promotion and education activities as revolutionary historical and cultural themed exhibitions, revolutionary film and television broadcasts and people’s forums based on revolutionary relics to showcase the style and features of revolutionary relics and inherit revolutionary traditional culture.

  article 22 the organizers of exhibitions of revolutionary sites and movable revolutionary objects may hire full-time or part-time interpreters to engage in the reception of visitors and daily promotion. in this regard, a talent training and incentive mechanism for interpreters may be established to standardize the selection, employment, training, assessment, motivation and exchange of interpreters, and the culture, radio, television and tourism authority and the veteran affairs authority shall provide corresponding guidance and support.

  article 23 the organizers of exhibitions of revolutionary sites and movable revolutionary objects may establish an on-going volunteer service mechanism, cooperate with volunteer service organizations in organizing volunteers to participate in daily operation and service work such as consultation service, guide, explanation and promotion of revolutionary relics, and provide necessary professional training to volunteers.

  these organizers may invite descendants of revolutionary ancestors and their families, old soldiers, heroic models, experts and scholars and young students to serve as volunteer interpreters to spread revolutionary culture and promote the transmission of revolutionary spirit.

  article 24 revolutionary museums, memorials, exhibition halls, revolutionary martyrs’ cemeteries, archives and other similar organizations may establish a cooperation and sharing mechanism among them, and cooperate in such aspects as display and exhibition, scientific research, publicity and education, personnel training and social services through venue alliances, paired assistance and the main-branch exhibition venue system to share venue resources and advance the promotion and display of revolutionary relics.

  article 25 the education authority shall support schools to establish cooperation mechanisms with revolutionary museums, memorials, exhibition halls, revolutionary martyrs’ cemeteries, archives and other similar organizations, so as to promote the integration of revolutionary culture into campus, namely, integrating revolutionary culture into such teaching contents as ideological and moral education, historical culture courses and social practices.

  article 26 the municipal and district people’s governments shall incorporate the protection and utilization of revolutionary relics into the tourism development planning, tap the tourism resources of revolutionary relics on the premise of causing no damage to the historical style and features of revolutionary relics, and integrate the revolutionary relics with such cultural and natural resources as natural landscapes and intangible cultural heritages, so as to develop and create the unique red tourism brands in guangzhou.

  the municipal and district people’s governments shall select villages and towns with abundant revolutionary relics, distinct red culture and good tourism foundation to improve their infrastructures and public service facilities such as roads and information communication system, so as to create red cultural tourism villages and promote rural revitalization.

  the municipal people’s government shall promote revolutionary culture themed tourism cooperation with relevant organizations in the guangdong-hong kong-macao greater bay area to jointly create tourism products and boutique routes.

  organizations and individuals are encouraged to invest in various forms in tourism and related industries that are compatible with the protection and utilization of revolutionary relics.

  article 27 organizations and individuals are encouraged to take advantages of revolutionary relics resources to create and disseminate various literary and artistic works themed by promotion of revolutionary culture, and promote such online innovative works as micro videos, micro films and animations through cloud livestreaming, cloud exhibitions, etc.

  the culture, radio, television and tourism authority shall support art troupes and literary and art workers to join revolutionary site protection organizations and collection organizations of movable revolutionary objects to carry out literary and artistic creation and performances themed by revolutionary culture.

  article 28 revolutionary site protection organizations and collection organizations of movable revolutionary objects are encouraged to take advantages of revolutionary relic resources to develop cultural and creative products through cooperation, authorization, independent development, etc. the culture, radio, television and tourism authority shall provide guidance for the development of related cultural and creative products.

  guangzhou encourages and guides social capital to invest in the development of cultural and creative products related to revolutionary relics, and form a multi-channel investment mechanism.

  state-owned revolutionary site protection organizations and state-owned collection organizations of movable revolutionary objects shall use in accordance with relevant regulations the income from cultural and creative products obtained to strengthen the protection and utilization of revolutionary relics.

  article 29 any organization or individual shall have the right to prevent or stop the actions that go against laws, regulations and rules related to the protection of revolutionary relics, and may make complaints and reports through government service hotlines, mailboxes or emails. the receiving authorities shall promptly investigate and handle the complaints and reports and give replies to the complainant/informant.

  article 30 these measures shall come into force on may 10, 2023.
