measures of guangzhou municipality for the management of public toilets

  (issued on january 26, 2024in accordance with decree no. 203 of the people's government of guangzhou municipality and put into effect on april 1, 2024)

  chapter i general provisions

  article 1     these measures are formulated in accordance with regulations on the management of city appearance and environmental sanitation, rules of guangzhou municipality on the management of city appearance and sanitation and other relevant laws and regulations, on the basis of the actual conditions of this municipality and with a view to strengthening the management of public toilets in this municipality, facilitating the public use, improving the public service level, promoting civilization construction in urban and rural areas and creating a good urban image.

  article 2     these measures shall apply to the planning, construction, use, maintenance and supervision and management of the public toilets within the administrative areas of this municipality (hereinafter referred to as “public toilets”).

  article 3     the term “public toilets” herein refers to the toilets established on both sides of roads, public places and the like for public use. public toilets are classified by management authority and location as municipal-facilities public toilets, park public toilets, rural public toilets and social public toilets.

  article 4     the management of public toilets shall follow the principles of scientific planning, reasonable layout, classified management, high safety and cleanness, convenience and practicality for the public, energy conservation and environmental protection.

  article 5     the municipal and district people’s governments shall strengthen their leadership in the management of public toilets, make coordination to solve problems encountered in the planning, construction, maintenance and management of public toilets, and provide relevant funding support.

  the town people’s governments and subdistrict offices shall fulfill their respective tasks on the management of public toilets within their respective administrative areas.

  article 6     the municipal urban management authority shall be responsible for the overall planning, coordination, guidance, supervision and management of public toilets throughout this municipality, and shall organize the implementation of these measures. the district urban management authorities shall be specifically responsible for the construction, maintenance and management of municipal-facilities public toilets, as well as the supervision and management of other public toilets within their respective administrative areas.

  the forestry and landscaping authorities shall be responsible for coordinating the construction, maintenance and management of park public toilets.

  the agriculture and rural affairs authorities shall be responsible for coordinating the construction, maintenance and management of rural public toilets.

  the authorities in charge of transportation, culture, radio, television and tourism, health, industry and information technology, sports, port affairs and the like shall fulfill their respective tasks on the management of social public toilets.

  article 7     this municipality encourages the introduction of intelligent devices and the installation of intelligent management systems for environmental monitoring, odor control, intelligent lighting and emergency assistance in public toilets, and promotes the application of new products in such fields as sterilization, disinfection and deodorization.

  article 8     this municipality encourages the introduction of personalized concepts and artistic creativity to the design of public toilets in terms of appearance and spatial structure for embodying the cantonese culture and trend of the times, provided that such designs shall not violate public order and good morals.

  chapter ii planning and construction

  article 9     the municipal urban management authority shall, in conjunction with relevant authorities in charge of forestry and landscaping, agriculture and rural affairs, formulate plans for the construction of public toilets based on the density of residential population, the number of mobile population and the needs of specific areas such as public places. for those involving spatial layout and land use requirements, relevant procedures shall be handled as required.

  when formulating special plans for the industry and detailed national territory spatial plans, relevant authorities shall comprehensively consider the needs of public toilet construction and specify the goals and requirements of public toilet construction.

  article 10   for the following areas and places, public toilets shall be established in the locations as required in the plans:

  (1)both sides of the main traffic arteries;

  (2)tourist attractions, public cultural venues, parks, public green spaces, public squares, commercial streets, sports venues and medical institutions;

  (3)passenger stations, subway stations, train stations, highway service areas, passenger docks, airports and petrol/gas stations;

  (4)farmer’s markets, pedlars’ markets and professional markets;

  (5)industrial parks, commercial and trade centers and residential communities;

  (6)places near public places in rural areas and densely populated and inhabited areas;

  (7)other places that shall have public toilets.

  article 11    the planning and natural resources authorities shall include the floor areas and planning requirements of public toilets into the planning conditions.

  the project investors shall construct public toilets in accordance with the requirements of the planning conditions and design schemes, synchronize the design, construction, acceptance and use of public toilets with the main project, with the required funds being included in the total investment of the construction project.

  when organizing the completion acceptance of a construction project, the project investor shall notify the relevant urban management authority to participate in the completion acceptance of the public toilets attached to public building. where a public toilet fails to pass the acceptance check, the public building shall not be put into use.

  article 12   the design and construction of public toilets shall observe the requirements of relevant national, industry and local technical standards and specifications, and fit harmoniously with the surrounding architectural style, ecological environment and cultural environment.

  the design of public toilets shall focus on people-oriented services, and the construction of facilities and equipment configuration shall take into considerations the needs of the aged and the young, with wheelchair ramps, grab bars, accessible toilet cubicles and other accessible facilities and equipment established in accordance with regulations. for public toilets with a floor area of over 100 square meters, a gender-neutral toilet and an accessible toilet shall be established. for other public toilets, gender-neutral toilet may be established independently or in joint with an accessible toilet according to the actual situation. this municipality encourages public toilets to install amenities such as mother-and-baby rooms, if feasible.

  the design of public toilets shall reasonably arrange the ratio of male and female toilet cubicles, with the number of female toilet cubicles reasonably larger than male toilet cubicles. the ratio of female to male public toilet cubicles in densely populated areas shall not be less than 2:1; the ratio of female to male public toilet cubicles in other places shall not be less than 3:2, with one urinal calculated as half a toilet cubicle. unisex toilets and “tidal toilets” may be set up as appropriate. for public toilets in airports, train stations, sports venues, exhibition halls and other venues hosting international events, a certain proportion of pedestal toilets shall be set up.

  the construction of public toilets shall adopt water-saving sanitary appliances and be equipped with toilets, wash basins, lighting, ventilation, water supply and other infrastructures and equipment.

  article 13   public toilets that do not meet the current construction standards shall be renovated. if renovation is unavailable due to objective conditions, the property owner and the management entity of the building shall simultaneously upgrade and renovate the public toilets during the renovation of the whole building.

  article 14   independent public toilets shall be equipped with septic tanks and connected to the public sewage network. the fecal residue shall be regularly cleaned and be subject to harmless treatment. the feces are strictly prohibited from arbitrary discharge.

  in rural areas with relatively small population size, scattered inhabited rural areas and areas unconnected to public sewage network, rural public toilet feces shall be treated and reused locally and nearby for resource utilization.

  chapter iii use and maintenance

  article 15   this municipality shall implement a responsible person system for the maintenance and management of public toilets, and the persons responsible for maintenance and management shall be determined as follows:

  (1)for the managed by the district authority in charge of urban management, the unit designated by it shall be ; for the municipal-facilities public toilets managed by the town people’s government and subdistrict office, the management agency designated by it shall be the person responsible for maintenance and management.

  (2)for the park public toilets managed by the municipal and district authorities in charge of forestry and landscaping, the park management agencies shall be the persons responsible for maintenance and management; for the park public toilets managed by the town people’s governments and subdistrict offices, the management agencies designated by them shall be the persons responsible for maintenance and management.

  (3)for the rural public toilets managed by the town people’s governments, the management agencies designated by them shall be the persons responsible for maintenance and management; for the rural public toilets managed by villagers’ committees, the villagers’ committees shall be the persons responsible for maintenance and management.

  (4)for social public toilets, the management authorities shall be the persons responsible for maintenance and management; if there is no management authority, the property owner shall be the person responsible for maintenance and management.

  the persons responsible for maintenance and management may entrust a professional service agency to undertake the daily maintenance and management of public toilets, and supervise the work of the entrusted professional service agency.

  article 16   the maintenance and management of public toilets shall comply with the prescribed standards and meet the following requirements:

  (1)good ventilation and lighting, no mosquitoes, flies and maggots, and no obvious odor;

  (2)the ground shall be free of accumulated water, urine, cigarette butts, paper scraps, and other debris. the walls, ceilings, and partition boards shall be free of graffiti, posting, burning, dust, spider webs, or other dirt. the exterior eaves and doors and windows of the building shall be kept intact and tidy, and regularly cleaned or decorated;

  (3)the toilet shall be free of urine alkali, dirt, and accumulated feces, with unobstructed drainage and no overflow of feces. the septic tank shall be sealed, and the washbasin shall be free of debris;

  (4)the appearance of facilities and equipment shall be clean and tidy, with good working conditions, and no missing, damaged, loose or rusted parts. in case of any malfunction in the facilities and equipment, repair shall be completed within the prescribed time limit;

  (5)public toilet guide board, sign, and information board shall be set up according to specified standards;

  (6)other requirements of laws and regulations concerning environmental sanitation management.

  article 17   the person responsible for the maintenance and management of public toilets shall strengthen safety work in the following aspects, prevent and reduce safety accidents, and ensure personal and property safety:

  (1)regularly carry out safety education and training;

  (2)standardize the allocation and use management of labor protection supplies, sanitizers, disinfectants and cleaning agents;

  (3)safety warning signs shall be set up during cleaning, sanitization, disinfection, repair and maintenance of facilities and equipment;

  (4)when carrying out operations in septic tanks, the guidelines for safe operations in confined spaces shall be strictly followed;

  (5)fire-fighting equipment and facilities shall be installed as required.

  article 18   public toilets shall be open to the public for free, and charging in any form or by any reason is strictly prohibited. municipal-facilities public toilets and park public toilets shall provide toilet paper and hand sanitizer for free. this municipality encourages other public toilets to provide toilet paper and hand sanitizer for free.

  this municipality encourages administrative authorities, enterprises and public institutions, social organizations and other entities close to the streets in this municipality to keep the toilets established on the first floor open to the public for free during working hours, hang relevant free use signs, and do a good job in relevant maintenance and management work.

  article 19   municipal-facilities public toilets and park public toilets shall be cleaned by dedicated personnel and managed as follows:

  (1)for those located in densely populated areas, the opening time shall be 24 hours, with a cleaning work time of no less than 16 hours;

  (2)for those located in other areas, the opening time shall be no less than 16 hours, and the cleaning work time shall be no less than 12 hours.

  this municipality encourages arrangement of professional teams for patrol cleaning of rural public toilets, with an opening time of no less than 12 hours and a cleaning work time of no less than 8 hours.

  this municipality encourages arrangement of dedicated personnel for cleaning of social public toilets, with opening time and cleaning work time implemented as per paragraph 1 of this article.

  for venues with fixed opening and operation time, the opening and cleaning work time of public toilets shall be consistent with the operation time of the venues.

  article 20   users of public toilets shall abide by the provisions on public toilet management, use public toilets in a civilized manner, maintain environmental sanitation, take good care of facilities and equipment, and not engage in any of the following behaviors:

  (1)scribble and post haphazardly;

  (2)spit and litter everywhere;

  (3)urinate and defecate outside the toilet;

  (4)theft and destruction of public goods and facilities in public toilets;

  (5)insult and assault public toilet workers;

  (6)other uncivilized behaviors that affect the normal use of public toilets and behaviors prohibited by laws and regulations.

  article 21   the municipal urban management authority shall establish a mature public toilet information database and update it in a timely manner, and publicize such information as the geographical location and opening hours of public toilets to the public through search engines, communication information, map navigation and other internet information service platforms.

  the relevant municipal authorities shall submit information on newly built and demolished public toilets to the municipal authority in charge of urban management on a regular basis. the persons responsible for the maintenance and management of public toilets shall assist in updating and maintaining public toilet information.

  chapter iv supervision and management

  article 22   the funds for the construction, maintenance and management of municipal-facilities public toilets, park public toilets and rural public toilets shall be included in the municipal and district financial budgets for financial security. among them, the funds for the construction, maintenance and management of rural public toilets by the villagers’ committee shall be allocated by the district, town, and village as a whole.

  the funds for the maintenance and management of social public toilets shall be borne by the persons responsible for maintenance and management.

  article 23   the town people’s governments, subdistrict offices, relevant authorities and management authorities may improve the diversified funding guarantee mechanism through government purchases of services, adoption by enterprises, placement of commercial advertisement, and establishment of commercial service points. this municipality encourages social entities to invest in the construction and maintenance of public toilets.

  article 24   relevant municipal and district authorities, town people’s governments and subdistrict offices shall supervise and inspect the maintenance and management of public toilets, and urge the persons responsible for public toilet maintenance and management to promptly rectify problems discovered.

  article 25   the public toilets supervision and management authorities shall establish a complaint handling system, display the supervision telephone number, name of the management unit, and other information in a conspicuous place of the public toilets, promptly handle complaint and report matters, and provide timely feedback on the investigation and handling results.

  article 26   no organization or individual may dismantle, close, occupy or change the use purpose of public toilets and their ancillary facilities without authorization. if it is necessary to dismantle, close, occupy or change the use purpose of public toilets, relevant procedures shall be handled as required.

  article 27   water and power supply units shall ensure the water and electricity supply to public toilets and the stability of water and electric power networks, and shall not cut off water or electricity without authorization.

  article 28   emergency shelters used for disaster risk reduction and avoidance shall reserve emergency water, electricity, and sewage pipe connections for public toilets, and well manage the reserves of mobile public toilets and related emergency supplies.

  during large-scale commercial, cultural, sports, public welfare event or in case of a public emergency event, if there are no public toilets in the relevant places or nearby areas, or the existing public toilets cannot meet the needs for toilet facilities, the local authority in charge of urban management shall assist and cooperate with relevant units to set up mobile public toilets, provide cleaning services according to established standards, and dismantle them in a timely manner after the event.

  chapter v legal liabilities

  article 29   where a relevant administrative authority and its staff, in violation of these measures, fails to perform its/his/her duties according to law, or abuses its/his/her powers, neglects its/his/her duties, or practices favoritism and fraud, the competent authority shall order it/him/her to make corrections and impose punishment on the person in charge responsible and other persons directly responsible; if a crime is constituted, criminal liabilities shall be investigated and affixed according to law.

  article 30   whoever, in violation of the provisions of article 14 herein, arbitrarily discharges feces shall be punished in accordance with relevant provisions of regulations of guangdong province on prevention and control of water pollution and rules of guangzhou municipality on the administration of city appearance and sanitation.

  article 31   for other violations of the provisions of these measures, if there are punishment provisions in laws and regulations, such provisions shall prevail.

  chapter vi supplementary provisions

  article 32   the various public toilets referred to herein shall have the following meanings:

  (1)municipal-facilities public toilets refer to toilets for public use that are invested and constructed by the authorities in charge of urban management, or are handed over to the authorities in charge of urban management for maintenance by relevant units according to the planned supporting construction;

  (2)park public toilets refer to toilets for public use that are invested and constructed by the authorities in charge of forestry and landscaping within the parks;

  (3)rural public toilets refer to toilets for public use that are constructed by the town people’s governments and villagers’ committees in public places in rural areas;

  (4)social public toilets refer to toilets for public use other than municipal-facilities public toilets, park public toilets, and rural public toilets that are invested, constructed, maintained, and managed by property owners in tourist attractions (scenic spots), public cultural venues, sports venues, farmer’s markets, market fairs, professional markets, commercial complexes, airports, train stations, subway stations, passenger stations, passenger docks, highway service areas, medical institutions and other areas and places.

  article 33   these measures shall come into force on april 1, 2024.
